Definitions

Within these terms and conditions – My Nail Shop & Academy UK being “The Seller” and “The Buyer” being the purchaser of any goods purchased from “The Seller” are set out under these terms and conditions.

Ambassadors

The Terms & Conditions set out below are not intended for Ambassadors –
If you are an Ambassador you will have a signed contract which has outlined and specified your terms and conditions as set out and agreed to by both us “The Seller” and yourself.

No responsibility will be accepted by “The Seller” for any trained or untrained personnel without qualified supervision using or misusing any equipment supplied by “The Seller”. If you are a business customer it is your responsibility to ensure you are insured for the products you are using and we reserve the right to ask for proof of your professional status.

Online Orders

When placing an order to purchase a product from “The Seller” you will receive an email confirming receipt of your order including the details of the order.

Your order represents an offer to purchase a product which is accepted by us only when we despatch that product to you. Any products on the same order which are not despatched do not form part of that contract.

Please note we require a working contact number, a valid address and a valid email address.

Our main form of communication is via email, although we will try to contact by phone first if theres no response we will email you. “The Seller” accepts no responsibility for your typing errors when inputting your personal data.

Product Availability

All products are subject to stock availability. If we have insufficient stock to fulfil the order, we will notify you by e-mail at the address given by you in your order form. Stock is allocated on a first come first served basis once your order reaches our main server. “The Seller” does not guarantee the availability of any item based on stock figures shown. “The Seller” would like to advise”The Buyer” that some products may be in different packaging to originally shown, old or new its a matter of stock availability.

Prices

All prices quoted are shown in UK sterling.

We reserve the right to alter prices without notice. E&OE (errors and omissions expected).

Prices and special offers are correct at the time of goods being displayed on the website but are subject to alteration without prior notice. It is possible that some of the products in our catalogue may be mis-priced. If a product’s correct price is lower than the stated price on the website, we will charge the lower amount and send you the product. If a product’s correct price is higher than the price stated on the website, we will, at our own discretion, either contact you for instructions before despatch, or cancel your order and notify you of such cancellation.

Payment

Customer Payment will always be required before any items are despatched to you. Payment can be made in various ways, We accept Visa, MasterCard, American Express and PayPal payments.

Shortages & Damages

All goods must be inspected on delivery and as stated above, all claims for shortages or damages must be reported to “The Seller” within 24 hours of receiving.

Delivery

The seller’s policy is to dispatch goods within 24 hours of receiving an order. This can be subject to stock availability. Times quoted are in good faith but shall not be binding. As stated in shipping and postage “The Seller” can accept no responsibility for transport delays.

Festive Season Delivery

Due to the increase in courier demand over the festive season, we ask you to be aware that we can not guarantee our next day delivery service.

Cancellations

We accept No cancellation once order has been dispatched.

You may not extract or re utilise any part of the contents of this website without the written consent of “The Seller”. “The Seller” grants you a limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it. This licence does not include any resale or commercial use of this website or its contents, any downloading or copying of account information for the benefit of another seller.

Neither this website nor any part of it may be reproduced, duplicated, copied, sold, re-sold, visited or otherwise exploited for any commercial purpose without the consent of “The Seller”.

Force Majeure

“The Seller” are entitled to cancel or delay delivery of any orders. If they are delayed, hindered or prevented from delivery through circumstances beyond its control. Such circumstances shall include (but are not limited to) industrial action, accident, fire, Act of God or failure to deliver by suppliers or carriers.

General

“The Seller” reserves the right to restrict or refuse any order for application of credit at any time. “The Seller” takes special care to show correct sizes and specifications and such descriptions, whilst given as a guide, in good faith, are subject to alteration by “The Seller” without notice. All colours are as near as can be displayed on a computer monitoring.

Jurisdiction

These terms and conditions along with all contracts entered into are governed by and are to be construed in accordance with the laws of England and Wales. You agree to submit to the jurisdiction of the Courts of England and Wales in relation to any contract entered into under these terms and conditions.

“The Seller” is not responsible for any printing or typographical errors. Every effort has been made to display as accurately as possible the colours, size and appearance of our products displayed on the website. Colours seen can depend on your computer monitor, so we can not guarantee that the monitor being used will display the colours accurately.
